These Terms of Service (“Terms”) govern your access to and use of the websites, products, and services operated by Peter Prochazka – ROI Engine (“PROCH,” “we,” “us,” or “our”), including proch.io and related offerings such as Qualif.ai, Commandr, and Mindmesh (collectively, the “Services”). By using the Services, you agree to these Terms.
You must be at least 18 years old and able to form a binding contract to use the Services. If you use the Services on behalf of an organization, you represent that you have authority to bind that organization.
You agree to use the Services only for lawful purposes and in compliance with applicable laws and regulations. You may not:
Some features may require registration or submission of personal or business information. You are responsible for maintaining the confidentiality of credentials and for activity under your account. Where Qualif.ai or similar tools process credit or financial data, you are responsible for obtaining all required consents and complying with applicable consumer reporting and privacy laws.
All content, trademarks, logos, software, and materials provided through the Services are owned by PROCH or its licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to access and use the Services for their intended purpose.
The Services may integrate with or link to third-party tools (payment processors, analytics, credit bureaus, etc.). We are not responsible for third-party terms, policies, or practices.
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not guarantee uninterrupted or error-free operation, or that outputs (including credit or qualification results) are accurate for every use case.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PROCH AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100).
You agree to indemnify and hold harmless PROCH from claims arising out of your misuse of the Services, violation of these Terms, or infringement of third-party rights.
We may update these Terms from time to time. Continued use after changes are posted constitutes acceptance. Material changes may be communicated via the site or email where appropriate.
These Terms are governed by the laws of the jurisdiction in which ROI Engine operates, without regard to conflict-of-law principles. Disputes shall be resolved in the courts of that jurisdiction unless otherwise required by applicable law.
